Definitions
For the purposes of these Terms, the following definitions apply:
- Operator: PointsBet Australia Pty Ltd, a proprietary limited company incorporated in Australia, licensed as a sports bookmaker by the Northern Territory Racing Commission (NTRC), operating online wagering services to Australian residents, and associated with the review domain pointsbet-aussie.com for Points Bet.
- Services: All online and mobile betting, wagering, account, information, and related services made available by the Operator via https://pointsbet-aussie.com and any related applications or interfaces that reference these Terms.

- Player: A User who has successfully completed registration and whose wagering account with the Operator is active, verified and funded.
- Account: A personal wagering account opened and maintained with the Operator in the name of a Player, used for depositing funds, placing Bets, receiving winnings and managing Bonuses in accordance with these Terms.
- Bet or Wager: Any betting transaction accepted by the Operator from a Player via the Services, including but not limited to fixed-odds sports bets, racing bets, in-play bets and any other approved wagering products made available under the Operator's Northern Territory licence.
- Bonus: Any promotional credit, free bet, boosted odds, stake-back offer, or other incentive provided to a Player by the Operator, whether automatically or upon the Player's request or qualification, and always subject to specific promotional terms and these general Terms.
- Real Money Balance: The portion of a Player's Account balance that consists of funds deposited by the Player and any winnings that are not subject to ongoing wagering requirements or restrictions.
- Bonus Balance: The portion of a Player's Account balance that consists of Bonuses and any associated winnings that remain subject to wagering requirements, expiry dates, or other conditions.
- KYC (Know Your Customer): The identity verification process required under Australian anti-money laundering and counter-terrorism financing laws, and under the Operator's licence conditions, which may include verification of name, date of birth, address, and source of funds.
- Interactive Gambling Act: The Interactive Gambling Act 2001 (Cth), as amended from time to time, and any related Commonwealth legislation applicable to the provision or promotion of online wagering in Australia.
- Regulator: The Northern Territory Racing Commission and, where relevant, any federal or state authority with jurisdiction over gambling services in Australia.
- Business Day: A day other than a Saturday, Sunday or public holiday in the Northern Territory or Victoria, Australia.
- Self-Exclusion: A responsible gambling measure whereby a Player requests, or is required by the Operator, to be prevented from accessing the Services for a specified period or permanently.
Account Registration
Eligibility and age requirements
- Minimum age: You must be at least 18 years of age to open an Account and use the Services. By registering, you represent and warrant that you are 18 years or older.
- Location restriction: The Services are intended solely for Users physically located in Australia. You agree not to access or use the Services from outside Australia and acknowledge that geolocation and verification measures may be used to enforce this restriction.
- Legal capacity: You must have full legal capacity to enter into binding contracts under the laws of Australia and your state or territory of residence.
- One Account rule: You may hold only one Account with the Operator for the Services. Duplicate or linked Accounts may be suspended or closed, and associated Bonuses cancelled, in the Operator's reasonable discretion.
Registration process
- Information required: To open an Account you must provide accurate and complete information, including at least your full legal name, date of birth, residential address in Australia, email address, mobile number and any other details requested on the registration form.
- Email and mobile verification: The Operator may require you to verify your email address and/or mobile number by responding to a verification link or code sent to you. Your Account may remain limited until verification is completed.
- KYC and identity verification: In accordance with Australian AML/CTF laws and NTRC requirements, the Operator will conduct KYC checks. This may involve:
- Electronic verification through third-party databases; and/or
- Requesting copies of identification documents such as passport, driver licence, or proof of address; and
- Additional information about your source of funds or source of wealth where reasonably required.
- Accuracy and updates: You must ensure that all information provided at registration and thereafter is true, accurate and kept up to date. You must promptly update your details via the Website or by contacting [email protected] if any information changes.
Account security and User obligations
- Login credentials: You are responsible for maintaining the confidentiality of your username, password and any other security details associated with your Account. You must not disclose these details to any third party.
- Unauthorised use: You are responsible for all activity conducted through your Account, whether authorised by you or not. You must immediately notify the Operator at [email protected] if you suspect or become aware of any unauthorised access or security breach.
- Personal use only: Your Account is for your personal, non-commercial use only. You must not act as an agent, trustee or representative for any other person, nor allow any other person to use your Account.
- Verification reviews: The Operator may, at any time up to and including withdrawal requests, conduct additional identity, affordability, or security reviews. You agree to cooperate and provide any documents reasonably requested. Failure to do so may result in suspension or closure of your Account.
Betting & Gameplay Rules
General wagering conditions
- Product range: The Operator may offer fixed-odds sports betting, race betting, in-play betting where permitted by law, and other wagering products authorised under the Operator's Northern Territory licence. Availability of particular events or markets is at the Operator's discretion and may change at any time.
- Minimum and maximum stakes: Each Bet is subject to minimum and maximum stake limits, which may vary by event, market, and Player. These limits may be displayed on the bet slip or otherwise communicated. The Operator reserves the right to reject or partially accept Bets that fall outside applicable limits.
- Odds and acceptance: A Bet is deemed accepted only when it is recorded on the Operator's servers and appears in your betting history as "confirmed" or equivalent. Display of odds on the Website does not constitute an offer capable of acceptance until the Bet is confirmed.
- Cut-off times: Pre-match Bets must be placed before the official start time of the relevant event. In-play Bets (where permitted) must be placed before the relevant betting market is suspended. The Operator's recorded time of receipt is final.
Placing, cancelling and modifying Bets
- Irrevocability of confirmed Bets: Once a Bet has been confirmed by the Operator and appears in your betting history, you may not cancel, amend or withdraw that Bet, except where expressly permitted by the Operator's rules or applicable law.
- Obvious errors: If a Bet is accepted at odds or with terms that are clearly and demonstrably incorrect due to a technical or human error (for example, inverted lines, misplaced decimal points, or materially inconsistent prices), the Operator may void the Bet or settle it at the correct odds that were reasonably available in the market at the time the Bet was placed.
- Rule conflicts: Where specific sport or racing rules published by the Operator differ from these general Terms, those specific rules shall prevail to the extent of any inconsistency.
- Event settlement: Bets will be settled based on the official results declared by the relevant sporting or racing authority. If an event is postponed, abandoned, or rescheduled, settlement will be determined in accordance with the Operator's published sport- or race-specific rules.
Live betting, conduct and chat rules
- Live or in-play betting: To the extent permitted by Australian law, certain in-play betting opportunities may be offered. Delays in data transmission mean that odds and market availability are subject to rapid change; a Bet is only valid when recorded as confirmed on the Operator's servers.
- Responsible conduct: You must use the Services responsibly and refrain from:
- Engaging in any collusion, match-fixing, or unlawful activity;
- Using automated systems, bots, or scripts to place Bets or manipulate the Services;
- Attempting to gain an unfair advantage through arbitrage abuse, bonus abuse, or exploitation of errors.
- Live chats and communications: Where the Website or associated platforms provide chat or messaging features, you must not post or transmit any content that is abusive, threatening, defamatory, obscene, discriminatory, or otherwise unlawful. The Operator may monitor and moderate such communications and may suspend or terminate Accounts for breaches.
- Fraud and integrity: The Operator may investigate any activity it reasonably suspects to be fraudulent, in breach of sporting integrity, or otherwise contrary to these Terms or applicable law. This may include sharing information with regulators, sporting bodies, and law enforcement agencies.
Bonus Terms
Bonus activation and eligibility
- Promotional offers: From time to time, the Operator may offer Bonuses to eligible Players through the Website, via email to registered Users, or through other approved marketing channels. All Bonuses related to Points Bet and presented on pointsbet-aussie.com are governed by these Terms and by the specific terms of each promotion.
- Eligibility criteria: Eligibility for Bonuses may depend on factors such as:
- Residency and physical location in Australia;
- Successful completion of KYC verification;
- Minimum deposit or Bet amounts; and
- Absence of prior breaches of these Terms or bonus abuse.

Wagering requirements and timeframes
- Turnover conditions: Unless stated otherwise in the specific promotion terms, Bonus funds and any winnings derived from them must be wagered a specified number of times (for example, "x times turnover") before they may be withdrawn as Real Money Balance.
- Contribution rules: Not all Bets will contribute equally to wagering requirements. The Operator may specify that:

Prohibited actions and bonus abuse
- Irregular play: The Operator may, acting reasonably, deem the following to be abusive or irregular play:

- Opening multiple Accounts to claim repeated Bonuses;
- Coordinating betting activity with others to guarantee profits from Bonuses.
- Consequences: In cases of suspected Bonus abuse, the Operator may:
- Withhold, cancel or reclaim Bonuses and associated winnings;
- Adjust Account balances; and/or
- Restrict, suspend or close the Player's Account, subject to applicable law and licence conditions.
- Combining promotions: Unless expressly permitted in the relevant promotion terms, Bonuses cannot be combined or used in conjunction with other promotional offers. Only one active Bonus may apply to a qualifying deposit or Bet at any given time.
Payments & Withdrawals
Deposits
- Funding methods: Deposits may be made using payment methods made available on the Website from time to time, which may include:
- Debit and credit cards issued in Australia;

- Selected e-wallets; and
- Other locally compliant payment solutions.
- Ownership of payment instruments: You may only use payment methods held in your own name. The Operator may require proof of ownership and may reject payments or refund them to the original source if ownership is unclear.

Refunds, chargebacks and treatment of funds
- Refunds of Bets and Bonuses: Where a Bet is voided or cancelled in accordance with these Terms or specific betting rules, the stake (or relevant portion) will generally be returned to your Account's Real Money Balance. Bonus stakes may be returned to the Bonus Balance or cancelled in accordance with the promotion terms.
- Chargebacks: You must not initiate chargebacks or payment reversals without legitimate cause. Where a chargeback occurs, the Operator may:
- Deduct the disputed amount and any associated costs from your Account;
- Void related Bets and Bonuses; and/or
- Close or suspend your Account and report the matter to relevant authorities.
- Segregation of funds: The Operator will manage Player funds in accordance with its licence conditions and applicable Australian regulations. While commercially reasonable measures are taken to protect customer funds, you acknowledge that no system can be entirely risk-free and that the Operator is not a financial institution.
Limitation of Liability
Operator obligations
- Fairness and integrity: The Operator will provide the Services with reasonable skill and care, comply with the conditions of its NTRC licence and applicable Australian laws, and use reasonable endeavours to ensure that Bets are settled accurately based on official results.

Exclusions and limitations
- Technical failures: To the fullest extent permitted by law, the Operator is not liable for any loss or damage arising from:

- Indirect losses: The Operator is not liable for any indirect, consequential, incidental, special or punitive damages, including loss of profits, loss of data or loss of opportunity, arising out of or in connection with the use of the Services, even if advised of the possibility of such damages.
- Maximum liability: Subject to non-excludable statutory rights under the Australian Consumer Law and similar legislation, the Operator's total aggregate liability to you in respect of any claim relating to a specific Bet shall not exceed the amount of the stake of that Bet, or, where the claim relates to Account funds, the value of your Real Money Balance at the relevant time.
- Consumer guarantees: Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable legislation that cannot be excluded by agreement.
Intellectual Property Rights
Ownership and permitted use
- Proprietary rights: All content, trademarks, logos, graphics, layouts, software, databases and other materials displayed on or accessible via pointsbet-aussie.com in connection with Points Bet are owned by the Operator, its affiliates, licensors or other third parties and are protected by copyright, trademark and other intellectual property laws.
- Limited licence: You are granted a limited, non-exclusive, non-transferable licence to access and use the Website and Services for your personal, non-commercial betting activity in accordance with these Terms. No other rights are granted, whether by implication, estoppel or otherwise.
Restrictions
- Prohibited uses: Without the prior written consent of the Operator, you must not:
- Copy, reproduce, modify, adapt, translate, or create derivative works from the Website or its content;
- Distribute, transmit, publicly display, sell, lease, or otherwise exploit any part of the Website or Services;

Termination & Suspension
Operator's rights

- Fraud, money laundering, or other unlawful activity;

- That your continued use of the Services may place you at risk of harm in connection with responsible gambling obligations.
- Termination/closure: The Operator may close your Account by providing notice where:
- There is a serious or repeated breach of these Terms;

- Required by law, regulation or a direction from a Regulator.
User-initiated closure and self-exclusion

Dispute resolution
